Terms of Use

These Terms of Use ("Terms") govern your access to and use of the UseFax mobile application (the "App"), operated by the independent developer of UseFax ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

The App does not receive inbound faxes. Sent documents are stored in the cloud for user access.

3. Account and Subscription

3.1 Account Responsibility

You are responsible for maintaining the confidentiality of your device and Apple ID used to access the App.

3.2 Subscription and Billing

UseFax is offered on a subscription basis through Apple In-App Purchases. Billing, renewal, and cancellation are handled by Apple and governed by Apple's Media Services Terms.

We do not manage or control Apple's payment systems and are not responsible for billing errors caused by Apple.

5. User Content

You retain ownership of documents you upload or send through the App ("User Content"). By using the App, you grant us a limited, non-exclusive, and temporary license to store, process, and transmit User Content solely for the purpose of providing the Service.

6. Data Storage and Security

Sent documents are stored in the cloud. We use encrypted connections to transmit data.

7. Intellectual Property

The App, including its software, design, trademarks, and content (excluding User Content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.

8. Third-Party Services

The App may rely on third-party services (including telecommunications providers and cloud storage). We are not responsible for the availability, reliability, or performance of third-party services.

9. Service Availability

We do not guarantee that fax transmissions will be completed without delay, error, or interruption. Fax delivery depends on external networks and recipient fax systems beyond our control.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or use the App in a way that may cause legal liability or harm.

You may stop using the App at any time by canceling your subscription through your Apple account.

11. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Arbitration and Dispute Resolution (Canada)

Any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of the App (a "Dispute") shall be resolved exclusively by binding arbitration, except where prohibited by applicable law.

13.1 Arbitration Process

The arbitration shall be conducted in Canada, in English, by a single arbitrator, in accordance with the Arbitration Act applicable in the province of the user's residence, unless otherwise agreed by the parties.

The arbitrator shall have exclusive authority to resolve any Dispute, including disputes relating to the interpretation, applicability, enforceability, or formation of these Terms.

13.2 No Class or Representative Proceedings

You agree that any arbitration shall be conducted on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding against us.

Each party shall bear its own legal fees and costs, unless otherwise required by applicable law or awarded by the arbitrator.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where you primarily operate, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
